1. Services

Geodesy Data Solution provides IT services including but not limited to: website design and development, mobile application development, cloud infrastructure setup, hosting services, database management, SEO, and digital marketing. All services are subject to a separate service agreement or Statement of Work (SOW) that will outline the scope, timelines, and deliverables specific to your project.

2. Intellectual Property

Upon full payment, all custom-developed code, designs, and deliverables become the property of the client. Geodesy Data Solution retains the right to use screenshots and anonymised project summaries in its portfolio unless the client requests confidentiality in writing. Third-party frameworks, libraries, and tools remain subject to their respective open-source or commercial licences.

3. Payment Terms

Payment terms are defined in the project agreement. Standard terms require a 50% advance to commence work, with the remaining balance due upon project completion and before handover of final deliverables. Late payments beyond 15 days may attract interest at 1.5% per month. Geodesy Data Solution reserves the right to pause work on projects where payment is significantly overdue.

4. Client Obligations

The client is responsible for providing timely feedback, content, assets, and approvals required to progress the project. Delays caused by the client may impact the delivery timeline and may be subject to additional charges. The client warrants that all materials provided to Geodesy Data Solution do not infringe third-party intellectual property rights.

5. Confidentiality

Both parties agree to keep confidential all non-public information exchanged in connection with services. This includes business processes, pricing, technical specifications, and personal data. Confidentiality obligations survive the termination of any service agreement for a period of two years.

6. Limitation of Liability

Geodesy Data Solution's aggregate liability for any claim arising out of or related to services shall not exceed the total fees paid by the client in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages including loss of revenue, data, or business opportunity.

7. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

8. Amendments

Refund Policy

At Geodesy Data Solution, we strive for complete client satisfaction. Please read this Refund Policy carefully before engaging our services.

1. Project Advance (Retainer)

The initial advance payment (typically 50% of project value) is non-refundable once project work has commenced, as it covers planning, resource allocation, and initial development work. If a client cancels before any work begins, a partial refund of the advance may be considered at our discretion, minus any administrative costs.

2. Milestone-Based Payments

Payments made against completed and approved milestones are non-refundable. If a client is unsatisfied with a deliverable, we will revise it in accordance with the agreed scope of work before processing any further milestone payments.

3. Hosting & Subscription Services

Hosting fees are billed in advance and are non-refundable for the current billing period. If you cancel mid-cycle, service will continue until the end of the paid period. No partial refunds are provided for unused hosting days.

4. Refund Eligibility

A refund may be considered in the following circumstances:

• Geodesy Data Solution fails to commence the agreed project within 14 working days of receiving payment, without a valid reason
• The delivered work significantly deviates from the agreed SOW and we are unable to rectify it within a reasonable timeframe
• A duplicate payment was made in error

5. Refund Process

To request a refund, email us at geodesydatasolution@outlook.com with your project details, invoice number, and reason for the request. Eligible refunds will be processed within 10–14 working days to the original payment method.

6. Disputes

Any disputes regarding refunds will be handled in good faith. If a resolution cannot be reached, the matter will be referred to arbitration in accordance with Indian arbitration laws.

Shipping & Delivery Policy

Geodesy Data Solution is a digital services company. We do not deal in physical goods. This policy outlines how we deliver our digital products and services.

1. Digital Delivery

All our services — including websites, mobile applications, designs, reports, and digital assets — are delivered electronically. Deliverables are shared via email, secure file transfer, shared drives (Google Drive / OneDrive), or directly deployed to the client's servers or hosting environments, as agreed in the project SOW.

2. Delivery Timelines

Project delivery timelines are outlined in the project proposal and Statement of Work signed before project commencement. Timelines are estimates and may be affected by:

• Delays in client feedback or content provision
• Scope changes requested by the client
• Third-party dependencies (domain registration, payment gateway approvals, etc.)
• Force majeure events

3. Software & Credentials Handover

Upon project completion and receipt of full payment, all source code, credentials, and documentation are transferred to the client. Handover is completed digitally and a confirmation email is sent once all assets are transferred.

4. Physical Documents

In the rare instance that physical documents (e.g., signed contracts, invoices) need to be delivered, they will be dispatched via reputed courier services. Delivery timelines will depend on the destination and the courier partner used. Charges for physical delivery, if any, will be communicated in advance.
